RENTAL ACKNOWLEDGMENT:

Guest understands that this policy and the reservation confirmation must be signed and returned to our office within 72 hours of receipt of these documents, or your cabin selection will not be guaranteed. We cannot confirm dates and/or cabin selection until all signed paperwork is received. Guest acknowledges and understands that he (she) is a licensee of the Owner and not a tenant; and that he (she) is not acquiring any interest in the property. It is understood that each unit is privately owned including the furnishings, with Eden Crest Vacation Rentals, Inc. acting solely as Agent for the Owner.

VERIFICATION:

A copy of the Guests' driver's license is required at check in, plus a copy of any credit cards used to pay for rentals or packages.

USE OF PREMISES:

Occupancy and use of premises shall not be such as to disturb or offend neighbors or residents. Fireworks and firearms are not permitted on, in or around any property managed by Eden Crest Vacation Rentals, Inc. These vacation homes were designed for individual and family use only. If a disruptive party or situation develops or is suspected, all guests will be asked to leave immediately without refund of payments or deposits. This policy is enforced without exception.

Eden Crest Vacation Rentals, Inc. hereby reserves the right to refuse service to anyone who they feel does not serve the best interests of the owner of the cabin. If it is determined at check in that inappropriate behavior will be transpiring in the cabin or the guest is representing a group of individuals Eden Crest Vacation Rentals, Inc. would otherwise not allow to check in, Eden Crest Vacation Rentals, Inc. reserves the right to refuse service and at its discretion no refund will be given. Eden Crest Vacation Rentals, Inc. reserves the right to enter and inspect the cabins without notice or the guest being present.

CHECK IN/CHECK OUT:

The Guest(s) understand and agree that check in time begins after 4:00 p.m. Every attempt is made to have cabins prepared for check in at that time, but access to the property is given when the home has been cleaned and inspected. No one can pick up a key or lock combination except the renter, unless prior arrangements have been made. Check out time is no later than 10:00 a.m. with no exceptions. An additional night's stay will be charged for late checkouts.

All Guests who arrive after our office closes will be provided a map and key code to the cabin for pick up at the rental office on Wears Valley Road. Late arrivals will need to visit the rental office by 12:00 p.m. the next business day to complete check in paperwork. Guests who do not complete check in paperwork by the end of business hours the day after arrival will be assessed a $50.00 late processing fee. Guests agree to abide by all guidelines given at check in.

USE OF THE PREMISES:

Guest(s) understand they are solely responsible for any property damage, accident, injury to any person(s) or loss sustained by any person, including loss of money, jewelry and other items of personal property, arising out of or in any way related to Guest(s) use of the premises or the items of personal property provided by Eden Crest Vacation Rentals, Inc. on behalf of the owner at Guest(s) request. Guest(s) shall inspect and be familiar with proper use and application of such items in the home prior to using them.

Most cabins have an inventory sheet which is provided to the guest on check in. Upon arrival at the cabin, Guest is to inspect the cabin against this inventory and report to the rental office any missing or damaged items. Guest authorizes charges for missing or damaged items not reported.

Guest (s) hereby agrees to indemnify and hold Eden Crest Vacation Rentals, Inc. and/or homeowner harmless from any and all claims including those of third parties, arising out of or in any way related to Guest(s) use of premises of the items of personal property provided therein. Guest(s) assumes the risk of injury or other losses relating to any recreational activities and will hold owner and its agents harmless with respect thereto.

DAMAGE/THEFT:

Guest(s) agrees to leave the premises in a clean, undamaged condition. In consideration of a $35.00 non-refundable damage waiver fee, guest will not be held responsible for unintentional damages for up to $1,000.00 which may occur to the property during the guest's occupancy period, if the damages are reported in writing. Guest shall be responsible for all intentional or reckless damages, which include damages while under the influence of drugs or alcohol, caused by any member of the party staying in or visiting the reserved cabin.
Eden Crest Vacation Rentals, Inc. reserves the right to require a damage deposit when Eden Crest management determines that the situation warrants it. The amount of the deposit will be determined by Eden Crest based on the situation. If damages exceed the deposit amount, the guest will be responsible for payment of charges in excess of the deposit.

Guest hereby authorizes the Agent to charge any expenses related to repairing intentional or reckless damage, cleaning of the unit beyond normal wear and tear or related to theft of any property from the unit to the Guest(s) credit card on file. Should the Guest(s) dispute the charges or the credit limit on the credit card not be sufficient to cover the theft and/or repairs/cleaning required due to excessive use of the cabin, Agent reserves the right to charge the Guest(s) with vandalism and pursue collection from the Guest(s) with venue being in the county of Sevier, State of Tennessee. All reasonable attorney fees will be at the expense of the Guest(s) should collection become necessary. Missing or damaged items from cabins will be replaced at current retail value plus a minimum $100.00 service fee and charged to the Guest(s), with the Agent reserving the right to adjust the service fee as necessary on a case-by-case basis.

MINIMUM STAY:

We have a two-night minimum stay on all reservations. Some holiday and other peak season weekends require a 3- or 4-night minimum stay. See our rates calendars to view these dates. Online reservations in violation of a minimum night stay will not be processed.

PAYMENT:

At the time of reservation, 50% of the reservation will be charged to your credit card. The remaining 50% is automatically charged to your card 10 days prior to your arrival. This same policy applies whether you have used a credit card or a debit card. DO NOT mail a check as payment for your balance due. Eden Crest Vacation Rentals, Inc. does NOT accept personal checks. Any change of credit cards must be done through our office if you do not want to use the same credit card for each payment. A processing fee will be incurred if an amount is taken off of one credit card and transferred to a different credit card. Processing fees may be applied if a reservation is changed.

CANCELLATIONS:

Any cancelled reservation is subject to our no-refund policy. We offer cancellation insurance through CSA Travel Protection. In lieu of forfeiture, Eden Crest Vacation Rentals, Inc. at their discretion may offer the guest the option of rescheduling the reservation at a later date with the following rules applied:
  1. The new reservation is at the published rate for the new dates
  2. The cabin must be managed by Eden Crest Vacation Rentals, Inc.
  3. The extended reservation change must be made no later than 30 days prior to the original date of arrival.
  4. The change must be approved by the management of Eden Crest Cabin Rentals, Inc.
  5. The guest must book the new reservation at the time of cancellation and the same cabin must be booked.

HOT TUB USAGE:

Hot tubs will be inspected after each rental. If any items such as soaps, bath products, food, alcohol, etc. are found in the tub, the Guest will be charged a cleaning fee of $150.00. Damage to any cover will result in a $350.00 charge. Covers should remain on the hot tub at all times when not in use. No children under the age of 12 years old are permitted in the hot tubs. Guest agrees to follow the hot tub usage instructions posted at the hot tub. If Eden Crest Vacation Rentals, Inc. is required to drain and clean the hot tub during the reservation, there will be an additional charge to be determined by the circumstances. Guest(s) authorize Eden Crest Vacation Rentals, Inc. to charge the credit card on file for any of the above charges. All hot tubs are drained, cleaned and refilled after every checkout. An additional charge of $50.00 will be added to your reservation to cover this. Guest is not to drain hot tub.

OCCUPANCY:

The minimum age to reserve a cabin is 21. Cabin occupancy is determined by the number of guest over the age of 12 years old. Eden Crest Vacation Rentals, Inc. does not charge a per person rate as long as the occupancy does not exceed the maximum number for the cabin being rented. If the occupancy is more than the maximum then the rental rate is increased by $15.00 per night/per person for the number of guests over that maximum.

CABIN SUPPLIES:

Eden Crest Vacation Rentals, Inc. will provide a starter supply of soap, dishwasher detergent, toilet paper, trash bags and paper towels. All cabins are supplied with linens and towels as well as kitchenware and utensils. All linens, towels, kitchenware and utensils are inventoried upon checkout. The Guest will be charged for any missing/damaged items on the credit card on file.

PETS/SMOKING:

Pets are allowed only in designated pet-friendly cabins, subject to our pet policy and with payment of a non-refundable pet fee. Our pet policy applies if a pet is present in the cabin at any time during a reservation. Smoking is not permitted inside any Eden Crest cabin. Smoking outside or on the decks is permitted. Charges will be assessed based on damages for any deviation.

ITEMS LEFT IN UNIT:

Eden Crest Vacation Rentals, Inc. will not be responsible for any personal items left in the units. A $20.00 service charge is required if you request us to pick up and ship any items left in the unit. Shipping is assigned to a third party shipping company.

MALFUNCTIONS:

We do not guarantee that utilities, appliances or amenities will not fail, but we do guarantee that repairs will be made as soon as possible. In the event repairs cannot be made timely, we reserve the right to move the guests to a comparable or upgraded cabin. No refunds will be given due to any failures. Guest understands and agrees that there are circumstances beyond the control of Eden Crest Vacation Rentals, Inc. and that no recourse or action can be brought against Eden Crest Vacation Rentals, Inc. for these circumstances. An example of the type of circumstances is malfunction of plumbing or electrical, construction activity or other situations over which Eden Crest Vacation Rentals, Inc. has no control.

SUBSTITUTION:

In the event that the owner of the vacation home elects to remove his property from our management responsibility, we will transfer the reservation to a comparable or upgraded cabin.

PREPAID RENT:

Prepaid rent is held in an interest bearing account with interest accruing to the benefit of Eden Crest Vacation Rentals, Inc.

PRIVACY STATEMENT:

Eden Crest Vacation Rentals, Inc. does not divulge a guest's personal information to any third party without the guest's expressed consent.

If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.

POLICY HIGHLIGHTS:

Only a starter supply of paper and soap products is provided. Maid service is not provided, but is available upon request for an additional fee.

 

Check-in begins no earlier than 4:00 p.m. local time. We will check guests in as soon as the cabin is ready after that time. We do not honor early check-in or late check-out.

 

No person under the age of 21 will be allowed to check in. If anyone under 21 reserves a cabin without our knowledge, they will not be permitted to check in and will not receive a refund.

 

We require a copy of the credit card holder's driver's license and credit card upon check-in. If the credit card owner will not be present at check-in, we will need a credit card authorization completed in advance. (Call for instructions.)
